Legislation

New Hampshire does not require homeowners or condominium associations to conduct reserve studies. However, the New Hampshire Condominium Act does impose financial disclosure requirements that promote transparency around reserve funding. Specifically, Section 356-B:40-c requires boards to annually adopt a proposed budget that includes reserve allocations and disclose how those figures were determined. Additionally, Section 356-B:58 mandates that public offering statements disclose whether a reserve fund exists and its current status. While there is no mandate for conducting reserve studies, these statutes emphasize the importance of financial planning for future repairs and replacements.
